Welcome to TripMigo. By accessing or using our application, you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By creating an account or using TripMigo, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use our service.

2. Description of Service

TripMigo is a trip planning and coordination platform that allows users to:

  • Create and manage travel groups ("Crews")
  • Plan and organize trips with other users
  • Coordinate payments, tasks, and itineraries
  • Communicate with group and trip members

3. User Accounts

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and current information
  • Notifying us immediately of any unauthorized use of your account

4. User Conduct

You agree NOT to:

  • Use the service for any illegal purpose
  • Harass, abuse, or harm other users
  • Post false, misleading, or fraudulent content
  • Attempt to gain unauthorized access to other accounts or systems
  • Use the service to send spam or unsolicited communications
  • Interfere with or disrupt the service

5. Payments and Credits

Credits: Trip planners purchase credits to publish trips. Credits are non-refundable once purchased. Each published trip consumes one credit.

Trip Payments: TripMigo facilitates payment coordination between trip organizers and participants. We are not a party to these transactions and are not responsible for disputes between users regarding payments.

External Payments: When using external payment methods (Venmo, Cash App, Zelle, PayPal, etc.), transactions occur directly between users outside our platform. We are not liable for any issues arising from these transactions.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The service will be uninterrupted or error-free
  • Defects will be corrected
  • The service is free of viruses or harmful components
  • The results of using the service will meet your requirements

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRIPMIGO AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, data, use, goodwill, or other intangible losses
  • Any damages arising from your use or inability to use the service
  • Any conduct or content of any third party on the service
  • Any injuries, accidents, or incidents that occur during trips planned through our platform
  • Any disputes between users regarding payments, accommodations, or trip arrangements

8. Indemnification

You agree to indemnify and hold harmless TripMigo and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the service, your violation of these Terms, or your violation of any rights of another party.

9. User Content

You retain ownership of content you post. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the service.

You are solely responsible for your content and must ensure it does not violate any laws or infringe on any third-party rights.

10. Termination

We may terminate or suspend your account at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes. Your continued use of the service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the service shall be resolved through binding arbitration, except where prohibited by law. You agree to waive your right to participate in class action lawsuits.
